Terms & Conditions

For supply & delivery of Bulk Water Tanks.

  • Definitions

    "Seller” means Kiff Hydrations PTY LTD t/a Laduuuuma, its successors and assigns or any person acting on behalf of and with the authority of Kiff Hydrations PTY LTD t/a Laduuuuma


    "Client” means the person/s buying the Goods as specified in any invoice, document or order, and if there is more than one Client is a reference to each Client jointly and severally.


    "Goods” means all Goods or Services supplied by the Seller to the Client at the Client’s request from time to time (where the context so permits the terms ‘Goods’ or ‘Services’ shall be interchangeable for the other).


    "Price” means the Price payable for the Goods as agreed between the Seller and the Client.

  • Acceptance

    The Client is taken to have exclusively accepted and is immediately bound, jointly and severally, by these terms and conditions if the Client places an order for or accepts delivery of the Goods.


    These terms and conditions may only be amended with the Seller’s consent in writing and shall prevail to the extent of any inconsistency with any other document or agreement between the Client and the Seller.


  • Price and Payment

    At the Seller’s sole discretion the Price shall be either:


    as indicated on any invoice provided by the Seller to the Client; or the Price as at the date of delivery of the Goods according to the Seller’s current price list; or the Seller’s quoted price which will be valid for a period of thirty (30) days.


    The Seller reserves the right to change the Price if a variation to the Seller’s quotation is requested.


    Time for payment for the Goods being of the essence, the Price will be payable by the Client 

    before delivery of the Goods.


    Payment may be made by EFT, unless another method of payment is agreed between the Client and the Seller. A proof of payment must be sent by the Client to the Seller to +27741469330 or email info@laduuuuma.com


    Prices quoted do not include VAT and delivery charges unless listed on an official quote by the seller.


  • Delivery of Goods

    Delivery ("Delivery”) of the Goods is taken to occur at the time that the Seller (or the Seller’s nominated carrier) delivers the Goods to the Client’s nominated address even if the Client is not present at the address.


    The cost of delivery is in addition to the Price quoted unless otherwise stated in writing by the Seller.


    The Client must take delivery by receipt or collection of the Goods whenever they are tendered for delivery. In the event that the Client is unable to take delivery of the Goods as arranged then the full invoice is payable and no refund shall be given.


    The Seller may deliver the Goods in separate instalments. Each separate instalment shall be invoiced and paid in accordance with the provisions in these terms and conditions.


    Any time or date given by the Seller to the Client is an estimate only. The Client must still accept delivery of the Goods even if late and the Seller will not be liable for any loss or damage incurred by the Client as a result of the delivery being late.


  • Delivery Charges

    Delivery is worked out from Atterbury Road Durban North. The distance to the site and back is worked out. 


    If there is more than one trip, then the delivery is charged per trip.


    R12 per km, deliveries within 5 kms will be free delivery.

  • Risk

     Risk of damage to or loss of the Goods passes to the Client on delivery and the Client must insure the Goods on or before delivery.


    If the Client requests the Seller to deliver the Goods to an unattended location then such Goods shall be left at the Client’s sole risk.


    The Client acknowledges that where possible, any tank storing the Goods should be positioned in a shaded area and it is recommended the tank be painted in a light colour to minimise the loss of water through evaporation.


    The Seller shall not be liable for any loss or damage to the site, including, without limitation, damage to pathways, driveways, concrete, paved or grass areas.


    The Client takes responsibility for damages caused when the truck is driven on any property for delivery. 


    The Client shall ensure clear and free access to the delivery site at all times to enable safe delivery of the Goods. 


  • Access

    The Client shall ensure that the Seller has clear and free access to the delivery site at all times to enable them to deliver the Goods. 


    The Seller shall not be liable for any loss or damage to the site (including, without limitation, damage to pathways, driveways and concreted or paved or grassed areas).


    The Client will disclose all essential information with regards to access issues on the initial order enquiry with the Seller including:


    • Any access limits for vehicles getting to the site. This includes the roads to site, parking on site or access restrictions including any housing estate access permissions or private road restrictions.
    • Access issues must be relevant to both an 8 ton truck and a bakkie, these are the vehicles that require access for the delivery of the water.
    • If more than 50m of pipe is required to pump the water from the parking to the destination of the water delivery.
    • Additionally, the client must estimate the distance to the tanks.
    • If water is to be pumped up more than 2 stories it is vital to be disclosed.
    • Any information regarding difficulty to reach the tanks or final destination must be disclosed.
  • Cancellation Policy

    A booking is confirmed after full payment of the invoice by the Client to the Seller, after proof of payment is received by the Seller. 


    In the event that the Client cancels the order of Goods, prior to the truck being dispatched, the Client shall be liable for 50% of the entire invoice.


    In the event that the truck has already been dispatched, the Client shall be liable for the full invoice amount and no refund shall be given.


    If no Client is available at the agreed time of delivery of Goods & the delivery is subsequently abandoned. 100% of the invoice will be due by the Client to the Seller and no refund will be due.


    The Seller may cancel any contract to which these terms and conditions apply or cancel delivery of Goods at any time before the Goods are delivered by giving written notice to the Client. 


    On giving such notice the Seller shall repay to the Client any money paid by the Client for the Goods. 


    The Seller shall not be liable for any loss or damage whatsoever arising from such cancellation.

  • Water Storage Risks

    Potable Water delivered to the Client is safe for drinking at the time of delivery. 


    To maintain the safety and quality of the Goods, the Client must ensure the environment of the storage tanks is fit for purpose and that the water is safe to drink after storage.


    The Client acknowledges that where possible, any tank storing the Goods should be positioned in a shaded area and it is recommended the tank is painted a light colour to minimise loss of water through evaporation.


    It is vital that water tanks storing potable water conform to safety standards so that water stored is safe for drinking. The Client assumes all risk & responsibility for the water purchased. 


    Once delivery has occurred, the ownership of the water and all risks associated with consumption of the water pass to the Client. 


    It is essential that the Client understands that contamination may occur during storage and takes steps to ensure the water continues to be safe for human consumption. 


    Non-potable water is not appropriate for human consumption & human contact. 


    Non-potable water tanks are unsafe for collecting water for consumption purposes.

  • Water Types

    Potable Water

    is stored water suitable for human consumption and is for drinking, bathing, washing dishes & utensils. Potable water is for any purpose that results in the ingestion of water or for when water comes into contact with the skin. 


    It is vital that water tanks storing potable water conform to safety standards so that water stored is safe for drinking. Once delivery has occurred, the ownership of the water and all risks associated with consumption of the water pass to the Client. 


    Non-Potable Water 

    is not appropriate for human consumption & human contact: Uses include plumbing, gardening applications, washing machine water, toilet and urinal flushing. 


    Non-potable water tanks are unsafe for collecting water for consumption purposes.


    The non potable water is clean ground water that has not been treated. The Client indemnifies Laduuuuma for any misuse or human consumption  that may result from the use of this water.
